3.1 Information You Provide: To use our Service, you must provide Account Information (name, email, password), Payment Information (processed securely through Stripe), Website Data (URLs submitted for auditing), and Profile Information (company name, contact details, preferences).
3.2 Account Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
4.1 Automatically Collected Information: Usage Data (pages visited, features used, time spent), Device Information (browser type, OS, IP address), Cookies (session cookies for authentication), Log Data (access times, error logs, performance metrics).
4.2 How We Use Your Information: Provide and maintain the Service, process transactions and manage subscriptions, perform website audits and generate reports, send service-related communications, respond to inquiries, improve the Service, detect and prevent fraud, comply with legal obligations, send marketing communications (with consent).
We do not sell your personal information. We may share with: Stripe (payment processing), third-party APIs (SEO and performance data), cloud hosting providers, email delivery providers.
We may disclose your information if required by law, court order, or government request, or to protect our rights and safety.
We implement appropriate measures: encrypted data transmission (SSL/TLS), secure password hashing (bcrypt), regular security audits, access controls, secure database storage, regular backups. No method of transmission is 100% secure.
We retain your information for as long as your account is active or as needed to provide services.

Arbitration Agreement

Arbitration Agreement / Class Action Waiver
"Claimant" and Custom Web Audits agree that, except for disputes that qualify for state courts of limited jurisdiction, any controversy or claim arising out of or related to this transaction shall be resolved by individual binding arbitration. This agreement applies to disputes involving Custom Web Audits and any subsidiaries or affiliates ("Other Parties").
Arbitration is the submission of a dispute to a neutral arbitrator for a final and binding decision. Arbitration provides for more limited discovery than in court and is subject to limited review. An arbitrator can only award the same damages and relief that a court can award.
The arbitration shall be conducted by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Any arbitration will take place on an individual basis; class, mass, consolidated or combined actions are not permitted. All parties are waiving the right to trial by jury and the ability to participate in class actions.
Arbitration will take place in the county where the transaction occurs, determined by a single arbitrator. Filing fees shall be paid by Claimant to the extent not exceeding court filing fees. The Federal Arbitration Act governs this provision. This agreement survives termination of the Service Agreement.
If any part is deemed invalid, this shall not affect the remainder of this arbitration provision.
For disputes under $15,000, parties submit arguments in writing; no hearing unless the arbitrator deems it necessary. For disputes $15,000-$50,000, Custom Web Audits pays Claimant's filing fee if both agree to document-only resolution.
All parties retain the right to seek adjudication in state courts of limited jurisdiction for individual disputes within scope.
WE ARE WAIVING THE RIGHT TO HAVE A TRIAL BY JURY.
WE ARE WAIVING THE RIGHT TO HAVE A COURT RESOLVE ANY DISPUTE.
WE ARE WAIVING THE RIGHT TO HAVE A COURT REVIEW ANY ARBITRATOR DECISION.
WE ARE WAIVING THE RIGHT TO PARTICIPATE IN CLASS, MASS, OR COMBINED ACTIONS OR ARBITRATIONS.
The arbitrator may award relief only to the individual party seeking it. An award applies only to that specific case. The arbitrator may not consolidate claims or preside over class proceedings.
The arbitration filing, proceedings, documents, briefs, and award shall all be kept fully confidential, except to enforce this provision or as required by law.
